Court upholds patent on Viagra

A proposed generic version of the erectile dysfunction treatment Viagra� (sildenafil citrate) would infringe an existing patent, according to a ruling by the Canadian Federal Court.

Drug firm Pfizer said the court in Toronto found Apotex’s planned generic would have impacted on its second medical use patent.

The judges granted an application from Pfizer for an order preventing Apotex from launching the generic treatment until the Canadian patent expires in 2014.

The decision is subject to appeal.
